Welcome to Josh Riders. These Terms of Service ("Terms") govern your use of our mobile application and website. By accessing or using Josh Riders, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Josh Riders, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

Age Requirement: You must be at least 18 years of age to use Josh Riders. By using our services, you represent and warrant that you are 18 years or older.

2. Description of Services

Josh Riders is a business services platform designed for commercial vehicle operators, providing:

• Truck Quotations: Vehicle pricing information and on-road cost calculations
• Loan Consultancy: Commercial vehicle loan assistance and application processing
• Insurance Services: Vehicle insurance quotes and policy management
• CIBIL Improvement: Credit score consultation and improvement guidance
• Fare Calculator: Route-based fare and toll estimation tools
• Payment Processing: Secure payment gateway for service fees

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You must verify your phone number via OTP authentication
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

3.2 Account Security

• You are solely responsible for all activities under your account
• Do not share your OTP or account access with others
• Use a secure device and internet connection when accessing the app
• Log out after each session, especially on shared devices

3.3 Account Suspension or Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Provide false or misleading information
• Engage in fraudulent activities
• Abuse or misuse our services
• Violate applicable laws or regulations

4. User Conduct and Prohibited Activities

You agree NOT to:

• ❌ Provide false, inaccurate, or misleading information
• ❌ Impersonate another person or entity
• ❌ Use the app for illegal purposes or fraudulent activities
• ❌ Attempt to hack, reverse engineer, or access unauthorized areas
• ❌ Upload viruses, malware, or harmful code
• ❌ Scrape, crawl, or extract data from the platform
• ❌ Interfere with or disrupt the app's functionality
• ❌ Use automated systems (bots) to access the app
• ❌ Harass, abuse, or harm other users or staff
• ❌ Submit fake documents or forged identification
• ❌ Create multiple accounts to abuse services

5. Services and Fees

5.1 Service Fees

• Some services require payment of fees as displayed in the app
• All fees are clearly disclosed before you complete a transaction
• Fees are non-refundable except as required by law or stated in our refund policy
• We reserve the right to change fees with 30 days' notice

5.2 Payment Processing

• Payments are processed securely through Razorpay, a third-party payment gateway
• You must provide valid payment information
• You authorize us to charge your payment method for applicable fees
• Payment disputes should be raised within 7 days of the transaction

5.3 Third-Party Services

We use third-party technology providers for:

• KYC verification providers (Sandbox.co.in)
• Credit score data via authorized third-party APIs (indicative only)
• Payment processing (Razorpay) for platform/consultation fees
• Maps and cloud infrastructure (Google)

We are not affiliated with, and do not partner with, any bank or NBFC. For motor insurance, the founder is a licensed IRDAI agent of The New India Assurance Co. Ltd. Your interactions with any financial institution or insurer are governed by their respective terms and conditions.

6. Loan and Insurance Information

6.1 Loan Consultancy

• We provide general information and guidance only
• We do not provide, arrange, or broker loans and we are not connected to any bank or NBFC
• Any loan is solely between you and the financial institution you choose to approach
• Interest rates, terms, and approval are decided entirely by that institution
• You are responsible for reading and understanding any loan agreement
• We do not earn any commission from lenders. We charge only an optional consultation/platform fee, if any, directly from you
• No guarantee: We do not guarantee any loan or its approval

6.2 Insurance (Licensed Agent)

• Motor insurance is offered by the founder acting as a licensed IRDAI agent of The New India Assurance Co. Ltd.
• Josh Riders itself is not an insurance company and does not underwrite policies
• Policies are issued by, and premiums/terms are set by, New India Assurance
• You must provide accurate vehicle and driver information for any policy
• Claims are handled directly by New India Assurance as per policy terms
• As a licensed agent, the founder may earn agent commission from New India Assurance as per IRDAI norms

6.3 CIBIL Improvement

• We provide guidance and consultation on credit score improvement
• We are not affiliated with CIBIL or TransUnion
• We do not guarantee specific credit score increases
• Results depend on your individual financial behavior and history
• Credit score changes take time and require consistent effort
• Credit scores are obtained through authorized third-party API providers
• Scores displayed may vary from official CIBIL reports

6.4 Regulatory Position

Our Role:

• Loans: Josh Riders is not a bank, NBFC, lender, broker, or DSA, and has no affiliation with any lender
• No loan commissions: We do not receive commission from any bank or NBFC
• Insurance: Motor insurance is offered by the founder as a licensed IRDAI agent of The New India Assurance Co. Ltd.; agent commission from New India Assurance may apply as per IRDAI norms
• Technology providers: KYC via Sandbox.co.in; payments via Razorpay (for our own platform/consultation fees)

For loans we provide information and consultancy only and do not require a lending licence. Insurance distribution is conducted under the founder's valid IRDAI agent licence with New India Assurance.

7. Document Verification and KYC

7.1 Document Requirements

• You may be required to submit identity and vehicle documents
• All documents must be genuine, valid, and unaltered
• Documents are verified using AI and may be manually reviewed
• Submission of fake documents will result in immediate account termination

7.2 KYC Compliance

• We comply with Know Your Customer (KYC) regulations
• KYC verification is required for certain services
• We use third-party providers (Sandbox.co.in) for verification
• Failure to complete KYC may limit access to services

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of Josh Riders, including but not limited to:

• Software code and algorithms
• Design, graphics, and user interface
• Logos, trademarks, and branding
• Text, images, and multimedia content

...are owned by Josh Riders and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use Josh Riders for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content or software
• Create derivative works or reverse engineer the app
• Remove copyright or proprietary notices
• Use our trademarks or branding without permission

9. Data Privacy and Security

Your use of Josh Riders is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

Key points:

• We use industry-standard encryption and security measures
• Your data is stored securely on Google Firebase servers
• We do not sell your personal information
• You have rights to access, update, and delete your data

10. Disclaimers and Limitations of Liability

10.1 Service Availability

• We are not responsible for the actions or failures of third-party service providers
• Loan approvals, insurance claims, and other decisions are made by third parties
• We do not control third-party websites or services linked from our app

10.3 Limitation of Liability

To the maximum extent permitted by law:

• Josh Riders and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the 12 months before the claim
• We are not liable for losses resulting from unauthorized account access if you failed to maintain account security

10.4 Accuracy of Information

• Vehicle pricing and specifications are sourced from third parties and may not be 100% accurate
• Loan and insurance quotes are estimates and may differ from final offers
• We strive for accuracy but do not guarantee error-free information

11. Indemnification

You agree to indemnify, defend, and hold harmless Josh Riders, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the app
• Your violation of any rights of another party
• Your submission of false or misleading information

12. Modifications to Services and Terms

12.1 Service Changes

• We may modify, suspend, or discontinue any part of our services at any time
• We may add or remove features without prior notice
• We are not liable for any modification or discontinuation of services

12.2 Terms Updates

• We may update these Terms from time to time
• Updated Terms will be posted with a new "Last Updated" date
• Significant changes will be notified via app notification or email
• Continued use after changes constitutes acceptance of new Terms

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Submitting a deletion request through our Data Deletion page

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• We suspect fraudulent activity
• Required by law or government authorities
• You engage in prohibited activities

13.3 Effect of Termination

• Upon termination, your right to use Josh Riders ceases immediately
• Pending transactions may be completed or refunded at our discretion
• Certain provisions (liability, indemnification) survive termination

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of Josh Riders shall be subject to the exclusive jurisdiction of the courts located in [Your City/State, India].

14.3 Dispute Resolution Process

1. Informal Resolution: Contact us first at hellojoshriders@gmail.com to resolve the issue informally
2. Mediation: If informal resolution fails, parties agree to attempt mediation
3. Arbitration/Litigation: Unresolved disputes may proceed to arbitration or court litigation

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Josh Riders.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any party at any time.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, wars, pandemics, internet outages, etc.).
